Asjaolud ja kohtumääruse põhjendused Harju Maakohtu 10.10.2014. a määrusega kinnitati Lindaliini aktsiaseltsi saneerimiskava, mille täitmise tähtajaks oli 31.12.2023. a. 03.10.2017. a esitas Lindaliini aktsiaseltsi saneerimisnõustaja kohtule avalduse saneerimismenetluse lõpetamiseks. Avalduse kohaselt nägi Lindaliini aktsiaseltsi saneerimiskava ette, et merivõlad tasutakse 3 aasta jooksul, muud pandiga tagamata kohustused 5 aasta jooksul ja pandipidaja Swedbank AS nõue vastavalt eraldi kokkulepitud maksegraafikule 10 aasta jooksul. Kokku oli saneerimiskavaga hõlmatud nõudeid summas 3 958 414,29 eurot. 29.09.2017. teostas Lindaliini aktsiaselts viimased maksed ja seega on tasutud kõik saneerimiskavaga kaasatud võlausaldajate nõuded ennetähtaegselt. Saneerimisnõustaja kinnitab, et saneerimiskava järgsed maksed on kõikidele kavaga hõlmatud võlausaldajatele täies ulatuses tasutud ja saneerimisnõustajal puuduvad ka tasunõuded Lindaliini aktsiaseltsi vastu. Saneerimisnõustajale esitatud andmete kohaselt on Lindaliini aktsiaselts pärast saneerimiskava kinnitamist suutnud oma majandustegevust jätkata, saneerimismenetluse lõpetamine mõjub ettevõttele positiivselt ning ettevõtte juhtkond saab keskenduda oma põhiülesannete täitmisele. Saneerimisnõustaja palub lõpetada Lindaliini aktsiaseltsi saneerimismenetlus seoses saneerimiskava ennetähtaegse täitmisega ning vabastada Andres Hermet saneerimisnõustaja ülesannetest. Saneerimisseaduse (SanS) § 38 lg 2 sätestab, et saneerimiskava ennetähtaegsel täitmisel lõpeb saneerimismenetlus, kui ettevõtja on kõik saneerimiskavaga võetud kohustused täitnud enne saneermiskava täitmise tähtaja lõppemist. Kohus on seisukohal, et kuivõrd Lindaliini aktsiaselts on enne saneerimiskava täitmise tähtaja lõppemist täitnud kõik saneermiskavaga võetud kohustused, tuleb Lindaliini aktsiaseltsi saneerimismenetlus lõpetada ning saneerimisnõustaja Andres Hermet SanS § 19 lg 1 p 2 alusel tema kohustustest Lindaliini aktsiaseltsi saneerimismenetluses vabastada.
